In most cases before starting Employment Tribunal proceedings claimants must now submit details of their complaint to ACAS, where they will be offered the option of a one month pre-claim conciliation before they can lodge the claim with the tribunal.
Then, only if conciliation is unsuccessful can the claimant lodge a tribunal claim.

ACAS Concilliation has a good record of settling disputes before they reach the Tribunal stage, so with proper legal advice for both employees and employers, embedding ACAS into employment dispute resolution process can only be a good thing.
