Why Do You Need Probate?

You might need a Grant of Probate (or Letters of Administration if there’s no Will) for:

• Accessing funds: Banks and financial institutions often require Probate to release money from the deceased’s accounts.
• Selling property: If a property is part of the estate, you’ll usually need Probate to sell it.
• Legal clarity: Probate protects executors and ensures the estate is handled correctly.

How Does Probate Work?

The probate process follows these key steps:

1. Register the death within five days.
2. Value the estate to calculate whether inheritance tax is due (including assets, investments, and gifts made in the last seven years).
3. Pay inheritance tax (if applicable). Even if the estate is below the inheritance tax threshold (which is currently £325,000), you still need to complete an inheritance tax form.
4. Apply for probate by submitting forms online or through the local probate office, including the death certificate, the Will (if there is one), and completed inheritance tax forms (if applicable).
5. Pay the probate fee (currently £300 for estates over £5,000; no fee for smaller estates).

How Long Does Probate Take?

The time it takes can vary depending on the estate’s complexity. On average:

• Grant of Probate application: 8–16 weeks after submission.
• Collecting assets and paying debts: 4–28 weeks, depending on the type and number of assets.
• Final estate distribution: Usually 4–8 weeks after everything else is settled.

In total, Probate typically takes 6 to 18 months, depending on factors like the size of the estate, whether there’s a valid Will, and how quickly third parties respond.

How Much Does Probate Cost?

At Fitzhugh Gates Solicitors, we offer transparent and fair pricing to suit your needs:

• Full estate administration: 1.95% + VAT of the estate’s gross value (e.g., £6,825 + VAT for a £350,000 estate). This includes all aspects of the process, from valuing the estate to distributing assets.
• Initial consultation: £250 + VAT for up to an hour, which we waive if you instruct us for full estate administration.

For smaller tasks, like obtaining a Grant of Probate only, we charge:

• £2,000 + VAT for estates with no inheritance tax.
• £3,500 + VAT if an IHT400 inheritance tax form is required.
